1. Scope and provider

These terms apply to ecu-mappack.com purchases from ECU-Tuningfiles, Robertstraße 81, 44809 Bochum, Germany. The offer is exclusively for businesses acting in their commercial or independent professional capacity. Consumer purchases are not offered. Company details, billing address and an express business-purchase confirmation are required.

2. Products

Previously: ECU data processing, tuning files and software optimisation.

Products are map definitions generated for an uploaded original file and supplied as CSV files for WinOLS: MapPack, DAMOS, or both. “DAMOS” means a CSV definition set with original names, not delivery of an original A2L or DAMOS source file.

No modified calibration values are supplied and the uploaded original file is not changed. The scope displayed before purchase and recorded in the order is decisive. The MapPack uses German labels or, optionally, English map names and folders with the same definition selection. DAMOS retains original names and folders.

3. Analysis, preview and contract formation

Previously: Upload/work order or purchase of credits followed by acceptance.

Upload and preview are non-binding and do not create a purchase. The preview shows map names, groups, dimensions, axis labels, counts and a simplified identification indicator. Addresses, factors, offsets, data types and map values are not supplied before purchase.

The customer selects a product, reviews the summary, provides the required billing details and submits a binding offer using the “Order with obligation to pay” button. A contract is formed by express acceptance by email. A technical receipt acknowledgement alone does not constitute acceptance. Inputs can be corrected before submission. The contract and terms are supplied by email on a durable medium. German or English may be selected as the contract language; mandatory consumer protection remains unaffected.

4. Individual purchases, prices and tax

Each purchase is a one-off transaction without an account or subscription. All listed prices are net plus applicable VAT. Tax treatment and the payable total are established before a binding payment. The bundle is the sum of both individual prices. MD1/MG1 pricing carries a 25% surcharge; configured request-only ECUs take priority. Foreign business purchases and reverse charge require a verified tax decision. The personal test supports German businesses and qualifying verified EU businesses.

For qualifying cross-border business purchases of digital definitions within the EU, reverse charge for services is planned. Automatic approval requires verified business use, the relevant receiving establishment and a valid foreign EU VAT ID with matching company details. Invoices include both VAT IDs and the reverse-charge notice. A German VAT ID does not by itself remove VAT on an ordinary domestic transaction. Missing or unavailable verification requires a hold or manual review.

5. Payment and release

Payments are processed through Mollie, including PayPal where available. Eligible methods depend on profile activation, country, device and transaction. A return to our site is not payment proof. Delivery requires a server-verified paid status. Open, pending, merely authorised, failed or cancelled payments do not unlock files.

We generate invoices ourselves after confirmed payment, using a separate sequential numbering scheme. Customers agree to electronic invoicing in checkout. Marked test invoices are not accounting documents.

6. Delivery and download

Previously: Delivery through an account or email, with general turnaround information.

After confirmed payment and successful preparation, a protected download link is provided on the success page and by email. Analysis may take several minutes and no fixed processing duration is promised. Delays are displayed. An invoice is supplied electronically.

The link is valid for 3 days from release, with a maximum of 3 complete downloads. Contact us with the order number if delivery fails. Technical limits do not restrict statutory remedies. The order number is included in the filename and import-compatible accompanying information. The CSV schema is changed only after compatibility testing.

7. Immediate digital delivery and returns

This is an exclusively business-to-business offer. A statutory consumer right of withdrawal is not provided for these contracts. Customers request immediate digital delivery after confirmed payment. No voluntary returns or refunds are offered for conforming delivered content. Statutory remedies for defects, non-delivery and other breaches remain unaffected.

8. Customer responsibilities and compatibility

Previously: Suitable vehicles and lawful use of tuning files.

Customers must supply a complete, unencrypted original BIN or ORI and be entitled to transmit and process it. Avoid unnecessary personal data. A Full Read and a Virtual Read are not equivalent. The file must match the WinOLS project into which definitions will be imported.

Using the definitions requires suitable WinOLS software and technical expertise. Tested versions and precise import requirements will be specified before live sales. The match indicator is a technical assessment, not a statistical probability of success. Weak matches allow a manual enquiry only; such an enquiry is not a paid order.

9. Agreed scope and defects

Previously: Best-efforts processing and no guarantee of individual error-free results.

Completeness of every theoretically possible map is not promised. The agreed characteristics are the specific definition scope offered and purchased. No additional guarantee of completeness or error-free operation is given. Mandatory requirements for conforming digital content and statutory remedies remain in force. Statutory remedies remain unaffected.

Report issues with your order number and a clear description. Reviewing the preview does not replace statutory rights.

10. Responsible use and liability

Previously: Broad exclusions for engine, gearbox and consequential damage.

The customer is responsible for technical review and use of the definitions. This product itself does not modify calibration values. Before further work, check map assignments, axes and plausibility in the specific project. Suitability for a particular power increase or legality of later vehicle modifications is not guaranteed.

The provider is liable without limitation for intent, gross negligence, injury to life, body or health and mandatory statutory liability. For ordinary negligence involving essential contractual obligations, liability is limited to foreseeable damage typical of the contract. Other liability for ordinary negligence is excluded where legally permissible. Mandatory statutory liability remains unaffected.

11. Usage rights

Previously: Use by the customer only, with no copying, resale or distribution.

The customer receives a non-exclusive right to use the definitions internally and to prepare their own customer calibrations. Standalone definitions may not be resold, publicly distributed or supplied as another MapPack without separate permission. Technically necessary backups and mandatory statutory use rights remain permitted.

12. Customer files and retention

Previously: No specific upload or deletion policy.

Uploads and generated outputs are deleted no later than 14 days after upload. A download is offered only if its full 3-day availability can fit within this period; otherwise a new upload is requested. Invoices and legally required contract evidence are retained separately according to applicable statutory periods.

Use of a customer file to improve the program requires separate, voluntary, unticked consent. It is not a condition of purchase and does not automatically extend file retention. See the Privacy Notice.

13. Availability, contact and jurisdiction

Previously: No uninterrupted service guarantee; Bochum jurisdiction where permissible.

14. Final provisions

Previously: Severability only.

German law applies without depriving consumers of mandatory protection in their country of habitual residence. If a provision is invalid, the applicable statutory rule replaces it and the remaining provisions continue to apply.
